Welcome to Kobi ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Kobi mobile application ("App"), an AI-powered interactive mystery game. Please read these Terms carefully before using our App.

By downloading, installing, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our App.

1. Acceptance of Terms

By accessing or using Kobi, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the App on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

2. Description of Service

Kobi is an AI-powered interactive mystery game application that allows users to:

• Generate and participate in AI-created mystery stories and script deduction games
• Select characters and difficulty levels for customized gameplay experiences
• Engage in interactive conversations with AI-generated characters
• Save and continue game sessions
• Access character profiles and story archives

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time, with or without notice.

3. Eligibility

You must be at least 13 years of age to use this App. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.

If you are a parent or guardian and believe your child under 13 has used the App, please contact us immediately so we can take appropriate action.

4. User Accounts

To use certain features of the App, you may be required to create a user account. You agree to:

• Provide accurate, current, and complete information when creating your account
• Maintain and update your account information to keep it accurate and current
• Maintain the security of your account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You may delete your account at any time through the App settings. Upon account deletion, your user data and game progress will be permanently removed as described in our Privacy Policy.

5. Acceptable Use

You agree not to use the App to:

• Violate any applicable laws, regulations, or third-party rights
• Generate, transmit, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the App or servers or networks connected to the App
• Attempt to gain unauthorized access to the App, other accounts, or computer systems
• Use automated systems (bots, scrapers, etc.) to access the App without our express written permission
• Reverse engineer, decompile, or disassemble any portion of the App
• Use the App to generate content for commercial purposes without our authorization

6. AI-Generated Content

The App uses artificial intelligence to generate story content, character interactions, and other creative materials. You acknowledge that:

• AI-generated content may contain errors, inaccuracies, or unexpected results
• AI-generated content is for entertainment purposes only and should not be used as a source of factual information
• We do not guarantee the accuracy, quality, or appropriateness of AI-generated content
• AI-generated content may occasionally produce content that is inappropriate or offensive, despite our safeguards

If you encounter inappropriate AI-generated content, please report it to us at support@kobicoco.com.

7. Intellectual Property Rights

The App, including its design, features, functionality, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any content you create using the App (such as game sessions and story progress). However, by using the App, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and process your content as necessary to provide and improve the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App or servers are free of viruses or other harmful components
• AI-generated content will meet your expectations or requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any conduct or content of third parties on or through the App
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of transmission to or from the App

Our total liability for any claims arising from or related to the App shall not exceed the amount you paid to us, if any, in the twelve (12) months prior to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any rights of another.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. You may delete your account at any time through the App settings, which will result in the permanent deletion of your data as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective Date" at the top. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the App and may delete your account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior agreements and understandings.
